1. Purpose

These terms and conditions of sale are entered into between FARSEM (hereinafter "Farsem") and internet users who wish to purchase a posting service on the platform available at https://farsem.net (hereinafter "the Customer").

These terms and conditions define the rights and obligations of the parties in connection with the sale of services by https://farsem.net to the customers of the platform.

These terms express the entirety of the parties' obligations, and the customer agrees to carefully read and accept these Terms and Conditions of Sale before proceeding with payment of an order on the platform.

The parties agree that their relationship shall be governed exclusively by this contract, to the exclusion of any other condition. Given the specific nature of the product, the buyer is invited to read these terms carefully.

FARSEM reserves the right to adapt or modify these terms at any time. In the event of a change, the conditions in force on the day of the order shall apply to each order.

The Customer must be: either a natural person over 18 years of age with full legal capacity to contract; or a natural person under 18 years of age who is emancipated.

2. Products and services

Farsem offers a service for posting publications to your Facebook groups. Within this framework, Farsem provides the resources required to allow the customer to send their publications as configured in their personal area, respecting the exact uploaded content, the scheduled dates and times, and the chosen target groups.

To optimise operation and comply with Facebook anti-spam rules, Farsem performs a number of operations to improve deliverability, such as: spacing out the sends; avoiding duplicate publication while a post is pending approval; cancelling publication in the event of a temporary block by Facebook.

Data privacy

Publications are sent from the customer's Facebook account; in this context, their personal Facebook information is kept strictly secure and confidential. This information is used solely to carry out the operations performed from the customer's personal area, and for no other reason.

FARSEM cannot be held liable for any service interruption or account block by Facebook: in the event of a temporary block of a Facebook account's sends, FARSEM blocks publication from that account until the block ends and re-credits the customer's sending balance. The customer's credits remain available and usable on any other non-blocked Facebook account.

Likewise, FARSEM cannot guarantee the proper delivery of posts to the customer's groups, as this is subject to the approval of the target groups' administrators. Any processed publication — whether accepted, refused or pending approval by a group administrator — will be counted against the customer's sending credit.

The content of publications is the customer's responsibility. FARSEM cannot be held liable for content prohibited by Facebook and reserves the right to refuse any publication it deems undesirable.

The maximum number of Facebook accounts per Farsem account is 100, but this may be increased with Farsem's agreement.

The usage period of Farsem credits is unlimited; however: after 2 months of inactivity, Farsem sends several reminders; after 3 months of inactivity, the credits are lost and the account is deactivated.

3. Intellectual property

All elements of the www.farsem.net website are protected by copyright, designs, trademarks or patents. They are the exclusive property of FARSEM. Reproducing all or part of the site constitutes infringement under the French Intellectual Property Code.

4. Force majeure

Pursuant to article 1148 of the French Civil Code, FARSEM cannot be held liable where any delay or non-performance results from an event of force majeure: any irresistible, unforeseeable circumstances beyond the parties' control, including carrier strikes and natural disasters.

5. Severability

Should any clause of these Terms and Conditions become void, illegal or unenforceable, this shall not affect the validity of the other provisions, nor release the Customer from performing their contractual obligations.

6. Disputes

These Terms and Conditions shall be performed and interpreted in accordance with French law. The parties shall seek an amicable settlement before any litigation. Failing this, only the Courts of Paris shall have jurisdiction.
